CONTEST RULES
Between November 19th, 2018 and December 14th, 2018, qualified people are encouraged to submit a nomination form explaining why their nominee deserves, or is in need of a vehicle. Nomination forms need to be completely filled out. You can nominate family, friends, neighbors, or anyone else you know who deserves and would be in need of a used vehicle.
This contest is open to residents of the county of Muskegon, Michigan only. The winning nominee will be chosen by a panel of judges after the closing date. The winning person will be eligible to pick up the vehicle on Wednesday, December 19th, 2018.

Contest Name: Enter to win the 2018 Wheels for Christmas Car Giveaway contest (“Contest”)
Joe’s Service Station will conduct the Contest substantially as described in these rules, and by participating, each participant agrees as follows:

1. Description of Contest/Participation
a. Dates of Contest: The Contest will begin on or about November 19th, 2018 and end on or about December 14th, 2018.
b. Joe’s Service Station will give away a refurbished 2004 Chevrolet Venture van to an individual in association with the Contest.
Participants must submit a nomination form and describe why the nominated person deserves, or is in need of a refurbished used vehicle. All submissions must be received no later than 5:00 pm on December 14th, 2018. Participants can nominate anyone other than themselves. Each participant should include their full name, address, phone number, and email address. Entries will be judged by a panel of judges selected by Joe’s Service Station.
The Contest winner will be chosen and the winner will be notified by telephone between December 14th, 2018, and December 19th, 2018. The prize will be delivered to the winner at an agreed upon date. Media representatives may be invited to attend the award ceremony.
c. How to Participate: Participants should submit their nomination forms at any one of the following locations noted below:
i. Joe’s Service Station at 3189 E. Apple Avenue, Muskegon, MI 49442;
ii. Advance Auto Parts at 1333 E. Apple Avenue, Muskegon, MI 49440;
2. Prize. The prize awarded to the eligible winner is one used 2004 Chevrolet Venture, the value of which will be determined as fair market value at the time the prize is awarded. Prizes are not transferable, redeemable for cash or exchangeable for any other prize. If a winner cannot be contacted or is disqualified, Joe’s Service Station reserves the right to determine an alternate winner or not to award the prize, in its sole discretion.
3. Eligibility and Limitations. Participants and winner must be a licensed driver at least 18 years old, who resides in the county of Muskegon, Michigan. Joe’s Service Station reserves the right to refuse to award a prize to or on behalf of any minor. Only one entry per person. Only one prize per household for the Contest. Employees of Joe’s Service Station, the Contest’s participating sponsors and their advertising agencies, and members of the immediate family of any such person are not eligible to participate and win. The term “immediate family” includes: spouses, siblings, parents, children, grandparents, and grandchildren, whether as “in-laws”, or by current or past marriage(s), remarriage(s), adoption, co-habitation or any other family extension, and any other persons residing at the same household whether or not related.
4. Publicity; Use of Personal Information. By participating, where allowed by law, all participants and the winner grant Joe’s Service Station exclusive permission to use their names, characters, photographs, voices and likenesses in connection with promotion of this and other contests and waive any claims to royalty, right, or remuneration for such use. By participating in the Contest, where allowed by law, participants agree that Joe’s Service Station may disclose person information obtained from participants in the Contest to third parties and use such information for marketing and other purposes.
5. Release, Waiver and Indemnification. By participating in the Contest, each participant and winner waives any and all claims of liability against Joe’s Service Station, its employees and agents, the Contest’s sponsors and their respective employees or agents, for any personal injury or loss which may occur from the conduct of, participation in, the Contest, or from the use of any prize. In order to receive a prize, participants must sign an official Acknowledgment, Waiver, Indemnification and Release of Claims form provided by Joe’s Service Station and provide insurance for the prize as required in said form.
6. Taxes. Any valuation of the prize stated above is based on available information provided to Joe’s Service Station, and the value of any prize awarded to a winner may be reported for tax purposes as required by law. Each winner is solely responsible for reporting and paying any and all applicable taxes related to the prize and paying any expenses associated with any prize which is not specifically provided for in the official rules. The winner must provide Joe’s Service Station with valid identification and a valid taxpayer identification number or social security number before any prize will be awarded. Any person winning over $600 in prizes from Joe’s Service Station will receive an IRS form 1099 at the end of the calendar year and a copy of such form will be filed with the IRS.
7. Conduct and Decisions. By participating in the Contest, participants agree to be bound by the decisions of Joe’s Service Station personnel. Persons who violate any rule, gain unfair advantage in participating in the Contest, or obtain winner status using fraudulent means will be disqualified. Unsportsmanlike, disruptive, annoying, harassing or threatening behavior is prohibited. Joe’s Service Station will interpret these rules and resolve any disputes, conflicting claims, or ambiguities concerning the rules or the Contest and Joe’s Service Station’s decisions concerning such disputes shall be final. If the conduct or outcome of the Contest is affected by human error, any mechanical malfunctions or failures of any kind, intentional interference or any event beyond the control of Joe’s Service Station, Joe’s Service Station reserves the right to terminate this Contest, or make such other decisions regarding the outcome as Joe’s Service Station deems appropriate. All decision will be made by Joe’s Service Station and are final. Joe’s Service Station may waive any of these rules in its sole discretion. ANY ATTEMPT BY A CONTESTANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY CIRCUMVENT, DISRUPT OR DMAGE ORDINARY AND NORMAL OPERATION OF THIS CONTEST OR WEBSITES, OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, COMPANY RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PARTICIPANT TO THE FULLEST EXTENT PERMITTED BY LAW.
8. Miscellaneous. Each winner must submit proof of eligibility and sign Joe’s Service Station’s release form to claim the prize. Joe’s Service Station may substitute prizes, amend the rules or discontinue the Contest at any time. Joe’s Service Station disclaims any responsibility to notify participants of any aspect related to the conduct of the Contest. All entries become the property of Joe’s Service Station and will not be returned.
9. Compliance with Law. The conduct of the Contest is governed by the applicable federal, state, and local laws, which take precedence over any rule to the contrary.
